What Sovereign AI Actually Means — And Why It Matters for the Public Sector
The phrase "sovereign AI" is being used a great deal at the moment, and like many terms that achieve rapid currency, it is in danger of meaning everything and nothing simultaneously. This piece is an attempt to give it a precise definition and explain why that precision matters — particularly for public sector organisations and those in regulated industries.
What sovereignty means in this context
Sovereignty, in the conventional sense, describes the right of a state to govern itself without external interference. Applied to AI, it describes something analogous: the right of an organisation — or a nation state — to use AI systems without their data, decisions, or intellectual property being subject to the control or influence of parties outside their jurisdiction.
In practical terms, sovereign AI involves three distinct but related things:
Data residency. Where is your data stored and processed? Most public AI tools process data on infrastructure operated in the United States. For UK public sector bodies, NHS organisations, and local authorities, there are often statutory, regulatory, or contractual requirements about where data can be held. "Stored on servers in Virginia" is not, for most purposes, compliant with those requirements.
Training data and model control. Is your data being used to train or improve AI models? And who controls the model itself? When you use a public AI tool, your interactions may contribute to the training of future versions of that model. You do not control when the model changes, how it changes, or what it has been trained on. For regulated organisations, this creates unpredictability and potential liability.
Operational control. Can you audit what the AI system is doing? Can you verify that it is working as described? Can you turn it off, change it, or move to a different provider? Many cloud AI services create significant lock-in, and the audit trails they provide are limited. For public bodies subject to freedom of information requirements and public accountability, this lack of transparency is a real problem.
Why this matters for the public sector specifically
Public sector organisations operate under a specific set of obligations that make AI sovereignty more than a preference — in many cases, it is a requirement.
The public sector handles personal data about citizens — health records, social care files, benefit applications, criminal records. The GDPR and, for law enforcement, the Law Enforcement Directive, set strict requirements about how this data is processed. Processing that data using an AI tool running on infrastructure outside the UK or EU, without appropriate safeguards, is likely to be unlawful.
There is also the question of accountability. Public bodies are accountable to the public, to Parliament, and to regulators. Decisions that are informed or assisted by AI systems need to be explicable and auditable. If an AI system produces an output that influences a consequential decision — about a benefit claim, a planning application, a procurement — the organisation needs to be able to show what the AI was asked, what it produced, and on what basis.
A black-box AI tool provided by an overseas company, with limited audit facilities and the ability to change its behaviour at any time, does not meet this requirement. A sovereign AI system — one that runs in a jurisdiction the organisation controls, has comprehensive audit logs, and does not change without notice — does.
The national security dimension
For some public sector organisations — defence, intelligence, critical infrastructure, border control — the sovereign AI question has an additional national security dimension.
The concern is not primarily about individual data breaches. It is about the aggregation of information about government activities, decisions, and capabilities in systems controlled by foreign companies. Even if each individual interaction is innocuous, the aggregate creates a picture that could be valuable to adversaries.
This is why several national governments have developed or are developing sovereign AI infrastructure — computing capacity and AI capabilities that run within national jurisdiction and are not dependent on foreign providers for their core operation.
What sovereignty looks like in practice
For most public sector organisations, the sovereign AI question is not about building national infrastructure from scratch. It is about procuring AI tools that meet sovereignty requirements — tools that can be deployed in UK or EU infrastructure, that do not send data to foreign servers, and that provide the audit and control capabilities that accountability requires.
The key questions to ask when evaluating an AI tool for public sector use are:
- ›Where is the data processed? Can this be limited to UK or EU infrastructure?
- ›Is our data used for training? Is this guaranteed contractually and architecturally?
- ›What audit logs are available? Can we demonstrate what the system did and when?
- ›What happens when the model is updated? Do we have advance notice and the ability to evaluate changes?
- ›What are the data deletion arrangements when we stop using the service?
- ›Does the supplier have a UK/EU-based legal entity that can enter into appropriate data processing agreements?
These are not exotic requirements. They are basic due diligence questions that any public sector procurement should ask of any software supplier handling personal or sensitive data. The novelty of AI does not change the fundamental obligations.
The opportunity, not just the constraint
It is worth acknowledging that sovereignty requirements can feel like constraints that limit access to the best AI tools. And it is true that some of the most capable AI systems are provided only as cloud services from major US technology companies.
But the capability gap is narrowing quickly. Open-source language models have improved dramatically in recent years, and can now match or approach the performance of proprietary systems for many professional use cases. AI tools that run on infrastructure you control — whether on-premise, in a sovereign cloud, or in a managed UK/EU environment — no longer require significant capability trade-offs.
The upside of sovereign AI, beyond compliance, is genuine. An AI system that runs inside your environment, processes only your documents, and is auditable by your team is a more trustworthy tool than one whose workings are opaque and whose data handling is governed by a terms of service document. For public sector organisations whose decisions affect people's lives, trustworthy tools are a professional and ethical requirement, not a luxury.
